Liberty Horsebox Hire Terms & Conditions 

 

1. Formation of the Contract

1.1 “You” means the horsebox hirer, and “we” or “us” means Liberty Horseboxes, of Lower Farm Barns, Bainton Road, Bucknell, Bicester, OX27 7LT. 

1.2 The terms and conditions in this contract apply to the hire of the horsebox and all services we supply to you. These terms may change without notice for any future hire. By signing, you acknowledge understanding and acceptance of the terms. 

1.3 This contract is governed by English law. 

 

2. Description and Price of the Hire Services

2.1 Horseboxes are subject to availability at the time of order. If the horsebox ordered is unavailable, we will inform you immediately. 

2.2 We make every effort to ensure the accuracy of prices in our quotations or website. If an error is found, we will inform you, offering either a reconfirmation at the correct price or the option to cancel and receive a refund. 

 

3. Payment and Cancellations

3.1 Upon booking, you are liable for the total hire fee. Payment terms are as follows: 

1. The full hire fee must be paid at the time of booking. Bookings are only confirmed after receiving the full fee.

3.2 Cancellation Policy: 

1. If you cancel more than 7 days before your booking, we will refund your payment minus a £25 administration fee.
2. If you cancel less than 7 days before your hire date, you remain liable for the full cost.
3. Each hire day is treated as a separate booking for cancellation purposes.

3.3 The horsebox will not be made available until all sums due have been paid. 

3.4 Payments sent by post are at your own risk. We are not responsible for lost or incorrectly completed payments. 

3.5 If payment is not received on time, we may release the horsebox for hire to other customers. You remain liable for the full cost of your booking if the horsebox is not re-hired. 

3.6 The first 300 miles per day are included in the hire charge. Additional mileage is charged at 35p per mile. 

3.7 A holding insurance excess fee of £750 will be charged at the time of booking, which may be increased to £1,500 subject to the number of points on your license.  

 

4. Collection

4.1 Collection is made at our premises on the agreed date and time of hire unless otherwise arranged. 

4.2 Hire begins when the horsebox is collected as per the agreed time and date. 

4.3 A Delivery and Acceptance Form will detail the horsebox’s condition. You must sign this form to confirm acceptance. Read the form carefully before signing. 

4.4 We aim to have the horsebox ready at the agreed time but are not liable for delays due to uncontrollable factors. 

4.5 The horsebox will have a full tank of fuel at the start. It must be returned with a full tank. If not, we will refill it and charge you for the fuel plus a £30 labour fee, charged to your deposit card. 

4.6 You must provide the following identification for all drivers: 

• A valid UK or EU driving license held for at least 2 years with no more than 6 penalty points. 

• Passport or photo ID (if using a non-photocard license). 

• A utility bill or bank statement showing your current address (no more than 90 days old). 

4.7 You may park your vehicle at our premises at your own risk for the duration of hire. 

 

5. Our Promise to You

5.1 We are not liable for defects arising from fair wear and tear, negligence, misuse, or unauthorized repairs. 

5.2 Nothing in these terms affects your statutory consumer rights. 

5.3 Complaints must be notified in writing. 

5.4 During the hire, we will: 

1. Provide roadside rescue if required.
2. Reimburse you for necessary repairs or maintenance, provided these are pre-approved and not caused by an accident or misuse.

 

6. Your Obligations to Us

6.1 You are responsible for obtaining all necessary documentation to legally drive our vehicles. 

6.2 All drivers must be aged between 23-75 years, holding a full UK/EU driving license for at least 2 years. 

6.3 During the hire period, you must: 

1. Ensure the horsebox is operated safely by licensed drivers.
2. Indemnify us against fines or penalties due to non-compliance with laws.
3. Not take the horsebox outside the UK without prior written consent.
4. Not sell, assign, lend, or dispose of the horsebox.
5. Not remove identification marks or plates from the horsebox.
6. Take steps to recover the horsebox if lost.
7. Maintain the horsebox, including fluid levels, cleanliness, and report damage immediately.

6.4 You must not: 

1. Use the horsebox for illegal purposes or non-approved uses.
2. Carry dangerous substances or impair the horsebox.
3. Smoke cigarettes, vapes or e-cigarettes
4. Allow pets in the horsebox without prior consent.

6.5 Notify us if the horsebox is involved in legal action or seized by authorities. 

6.6 Breaching obligations may result in contract termination and repossession at your expense. 

 

7. Insurance

7.1 Hire charges include insurance, but you are liable for an insurance excess fee of £750. This can increase up to £1500 subject to the point held on your license. 

7.2 Report accidents or damage immediately and complete an accident form.  

7.3 You indemnify us for any loss or damage in excess of the insurance excess. 

7.4 The insurance does not cover personal injury or third-party damages. 

 

8. Liability

8.1 We are not liable for personal or third-party property loss or damage. 

8.2 Our liability for breach of contract is limited to hire fees paid by you. 

8.3 We are not liable for consequential or indirect losses, including loss of profit. 

 

9. Return of the Horsebox

9.1 Return the horsebox on the agreed date and time in a clean, undamaged condition. 

9.2 Late returns will incur additional charges at our daily hire rate, plus recovery costs. 

9.3 If returned in unsatisfactory condition, you will be liable for cleaning or repair costs. 

 

10. Termination

10.1 We may terminate the contract if: 

1. You breach your obligations.
2. You become insolvent or unable to pay debts.
3. Circumstances arise affecting your ability to fulfill the contract.

10.2 Upon termination, we are entitled to recover the horsebox, and you are liable for repossession costs. 

 

11. Miscellaneous

11.1 This contract is the entire agreement between you and us. 

11.2 Amendments to this contract must be in writing and signed by both parties. 

11.3 If any part of this contract is found invalid, the remaining provisions remain in effect.
